These terms apply to your use of the DailyDo app for iPhone, iPad, and Mac ("the App"), operated by FRANCESCO BERTOCCI, LLC ("we", "us"). By downloading or using the App you agree to these terms and to Apple's Licensed Application End User License Agreement (the "Standard EULA"), which governs your license to the App. If these terms and the Standard EULA conflict, the Standard EULA wins.
DailyDo is a personal productivity tool for capturing and organizing tasks, notes, links, timers, podcasts and documents. You may use it for any lawful personal or professional purpose.
DailyDo is free to use with up to 50 active items; completed items don't count, and capture is never blocked. DailyDo Pro removes the limit and is offered as:
Prices are shown in the App before you buy and vary by country. Payment is charged to your Apple Account at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within the 24 hours before the period ends. You can manage or cancel subscriptions in your Apple Account settings (Settings → [your name] → Subscriptions). If you buy a subscription during a free trial, any unused part of the trial is forfeited. Refunds are handled by Apple under its policies. If Pro ends, your existing items stay readable and editable; only new active items beyond the free limit prompt you to upgrade. Use Restore Purchases in the App to unlock Pro on another device signed in to the same Apple Account.
Everything you create in the App is yours. We claim no ownership of, and have no access to, your content. It is stored on your devices and, if you use iCloud, in your personal iCloud account, as described in the Privacy Policy. You are responsible for the content you create and for what you share. Content you share from the App travels inside the link or file you send; once sent, it can't be recalled.
Don't use the App to store or share content that is unlawful or that infringes anyone else's rights, and don't use it to share other people's personal information without their permission.
Sync between devices depends on Apple's iCloud and your iCloud storage, which are outside our control. No software is immune to data loss, so keep your device backups (iCloud Backup or local backups) turned on. To the maximum extent permitted by law, we are not liable for loss of data.
The App can schedule reminders, alarms and timer notifications. Delivery depends on your device settings and on iOS and macOS behavior outside our control. Don't rely on the App as your only safeguard for critical, safety-related or time-critical obligations.
Links, web pages, podcasts, feeds and videos you open in the App come from third parties and are subject to their own terms. We aren't responsible for their content or availability.
We may update, change or discontinue features of the App at any time. Updates may be required for continued use. We won't remove a feature you have paid for without offering a reasonable alternative or a remedy required by law.
The App is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, reliability or availability, to the extent permitted by law.
To the maximum extent permitted by applicable law, FRANCESCO BERTOCCI, LLC shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or business, arising out of or related to your use of the App. Our total liability for any claim is limited to the amount you paid for the App or DailyDo Pro in the 12 months before the claim.
You may stop using the App at any time by deleting it; cancel any subscription in your Apple Account settings. We may suspend or end access to the App if you materially breach these terms.
These terms are governed by the laws of the United States and the state in which FRANCESCO BERTOCCI, LLC is registered, without regard to conflict-of-law principles. Nothing here limits rights you have under the consumer laws of your country.
If these terms change, the updated version will be posted on this page with a new "last updated" date.
